Central government employees will soon communicate through email ID - Minister of State for Communications Milind Deora

All Central government employees will soon be expected to communicate through the National Informatics Centre (NIC) email ID, a union minister said on Monday adding that the government was chalking out a plan in this regard.
Minister of State for Communications Milind Deora told reporters here that his department is working on a new email policy which will address this issue, among others.
“Once this is ready, then all government officials will have to communicate only through NIC email id,” he said.
“After this, the issue of cyber security can be addressed on a single platform as NIC is taking care of e-governance programmes of the Centre,” said Deora.

A question has been raised in the Parliament regarding the benefits of 6th CPC to the employees who retired before 1.1.2006, the Dopt Minister Shri V.Narayanasamy replied that the orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide this Department’s Office Memorandum(OM) dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.

The Central Administrative Tribunal, Principal Bench, New Delhi in its order dated 1.11.2011 observed that by the OM dated 3.10.2008 the original orders of 1.9.2008 have been modified. Hon’ble CAT directed that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension @ 50% of the minimum pay corresponding to the pre-revised pay scale with reference to the fitment table applicable for revision of pay of serving employees.
Writ Petitions were filed in the Hon’ble High Court of Delhi challenging the above mentioned order.
In its order dated 29.4.2013, the Hon’ble Delhi High Court has upheld the order dated 1.11.2011. After considering the order of Hon’ble High Court of Delhi and various representations received in this regard, Special Leave Petition was filed by the Department of Pension and Pensioners’ Welfare in the Hon’ble Supreme Court of India.
Department of Pension & Pensioners’ Welfare filed an SLP in the Hon’ble Supreme Court against this order. This SLP came up for hearing on 29.7.2013 and was dismissed and the Review Petition was also dismissed. 
Union of India has also filed SLP against the order dated 29.4.2013 in Writ Petitions No.2348/2012, 2349/2012 and 2350/2012 in the Hon’ble Supreme Court which came up for hearing on 19.11.2013. The Hon’ble Supreme Court directed to list the SLP alongwith CA No.8875-8876 of 2011 filed by Ministry of Defence and is now listed for hearing on 4.2.2014. The matter is therefore sub-judice.

Cabinet proposal soon to constitute 7th Pay Commission

The central government is likely to constitute the 7th Pay Commission for revising the salaries of its over 50 lakh employees before the start of process of next general elections due in May, 2014.
“The Finance Ministry is working out a Cabinet proposal for constitution of the 7th Pay Commission which could be taken up for consideration in the next couple of weeks,” a source said.

According to information available, the government’s intention to constitute 7th Pay Commission before going for polls is clear as it has made provision of Rs. 3.5 crore in the second supplementary demands for grants in this regard which was approved by Parliament in the just concluded Winter Session.
Earlier in September this year, Finance Minister P. Chidambaram had announced that Prime Minister Manmohan Singh has approved setting up of the 7th Pay Commission.
According to the announcement, the Commission will be mandated to submit its report in two years time and its recommendations would be implemented from January 1, 2016.
However, after that announcement, no formal proposal was put up before the Union Cabinet for constitution of the Commission.
As per the practice, the Commission is headed by a former Supreme Court Judge and its other members would include experts and officials.
Meanwhile, the government is also believed to have approved fixing minimum pension of Rs 1,000 per month under the Employees’ Pension Scheme 1995 (EPS-95) run by retirement fund body Employees’ Provident Fund Organisation (EPFO).
The government is also understood to have cleared maximum basic wage ceiling of Rs. 15,000 per month for deduction of Provident Fund from existing Rs. 6,500 per month for private sector workers, in general, covered under schemes run by EPFO.

Proposal to allow only BSNL MTNL telephones to Government employees

Minister of State for Communications and Information Technology has said in the Lok Sabha on 13th December 2013 that the proposal is under consultation and no decision has been arrived at…
Government had constituted a Group of Ministers (GoM) on 17.04.2013 to recommend short term, medium term and long term measures for revival and revitalization of Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telephone Nigam Limited (MTNL). Department of Telecommunications has circulated a draft Note for inter-ministerial consultations on 30.10.2013 proposing preferential treatment to BSNL and MTNL services in Central Government Ministries/Central Government Public Sector Undertakings (PSUs) and Autonomous Bodies to enhance the revenues earned by BSNL and MTNL.

The proposal is not contrary to economic policy as it is limited to Government employees for whom reimbursement facility from Government is provided and limited to the extent of the reimbursement and to Government departments & PSUs for official use. The matter is presently under consultation and no decision has been arrived at.

7th Central Pay Commission - Government has initiated the process

The Government has initiated the process to constitute the 7th Central Pay Commission along with finalization of its Terms of Reference, the composition and the possible time frame for submission of its Report. The date of effect thereof will be known once the Report is available.

This was stated by Shri Namo Narain Meena, Minister of State in the Ministry of Finance in a written reply to a question in the Lok Sabha on 06.12.2013.

 Brief of judgment :

The applicants who are holding the posts of ASPOs are provided from appearing for the departmental examination for promotion to the post of Sr. Postmasters, and only Inspectors of Posts which is lower grade post than the ASPOs are allowed to appear for the examination and in case they qualify in the examination, they would become seniors to ASPOs, which posts the applicants are holding and would be an anomalous situation. The contention of respondents that the applicants are holding Gazetted posts in the GP of Rs. 4600/- and as such, they need not be allowed to appear for exam cannot be accepted as the GP of Sr. Postmaster is Rs. 4800/-
